IRON MAIDEN fan site MaidenFans.com (www.maidenfans.com) reports that drummer Nicko McBrain was to appear in a Long Island, NY court again this morning (September 8th) for the ongoing parking attendant incident case that occurred on July 26th, 2003, before the Maiden concert at Jones Beach during the North American leg of the 2003 Give Me Ed... 'Til I'm Dead tour.
Stay tuned for information regarding Nicko’s court visit.
As previously reported at the time of the incident, Michael "Nicko" McBrain, 51, was arrested on an assault charge after he allegedly got angry at a Jones Beach Theater parking attendant and struck him with his Jaguar, cops said.
Nicko was apparently miffed after the attendant, who didn't recognize him, demanded to see a parking pass for the V.I.P lot outside the theater, said Maj. Richard O'Donnell of the New York State Park Police.
O'Donnell said McBrain arrived at Jones Beach around 8:30 p.m. for the group's concert, and was stopped as he entered the exclusive parking area. After a confrontation with the 30-year-old worker over credentials, the park employee stood in front of McBrain's car, blocking the lot entrance.
"The employee said Mr. McBrain struck him in the legs," O'Donnell said.
The man backed up, but stayed in front of the car. McBrain, told him to "move or he would hit him again," O'Donnell said.
The man refused to budge, and McBrain surged the car forward again, nailing him and causing the man to fall forward on the car's hood.
Concert security who witnessed McBrain's antics contacted the police on site, and McBrain was arrested.
After he was given a desk appearance ticket, he returned to the theater and joined his bandmates on stage in time for their performance.

Seems a money settlement was found out of court and the whole thing is over.
It's not confirmed, but not sure the parties have the right to talk about the issue anyway.
