Sanctuary Fights U.S. Royalties Lawsuit

Nick Goodway of the Evening Standard is reporting that Sanctuary, the independent music group which handles artists such as Guns N' Roses, Iron Maiden, Slipknot and Slayer, today rebutted claims made by California's 5.1 Label in a $50 million lawsuit.

London-based Sanctuary also said it had launched a countersuit, claiming Label failed to sell in any volume the 163 albums it had supplied to produce in its DualDisc format, with audio on one side and video on the other. Label is claiming breach of contract and fraud against Sanctuary.

Bert Deixler, U.S. lawyer for Sanctuary, said: "The royalty statements prepared by Label show that not one single artist sold in excess of 1000 units in any sixmonth period and the greatest sales for top-selling artists such as Bob Marley...averaged 250 units in the six months. In one six month period, Bob Marley had more discs returned than he sold. Rather than accepting responsibility for not being able to sell the product, they have reverted to litigation to create revenue."
