Looks like a Todd MacFarlane action figure. Albeit a very cool one
it is one - took me 2 minutes to find it on Spawn.com

Its fake. The image is of a spawn figure apparently. If you are in the UK, you can look on the teletext to find out about the cover on channel 4 page . It says the cover will be a painting of Helll by a 15th century painter called Hans Hemling which could be this one (thanks to GhostofCain):
